San Antonio jurors deadlock in massive case alleging corporate raid of insurer
State District Judge Angelica Jimenez granted a motion for a mistrial and ordered the parties back to mediation to try to resolve the dispute. A jury in San Antonio has hung up after more than 10 hours of deliberations in Argo Group's $900 million lawsuit accusing rival insurer and two former executives of raiding its surety business. The judge granted Argo's motion for a mistrial after jurors couldn't reach a verdict and ordered Argo and Dual North America Inc. back to mediation. The lawsuit accuses Dual and former Argo executives Mark Farina and Brendan Keating of orchestrating the departure of 27 employees from Argo’s surety division in 2023. The defendants deny the allegations. Argo accused Dual of using the departing employees to build a competing surety operation. The timing of the departures negatively impacted Argo negotiations with reinsurers and led to the transfer of about 80% of its surery bond portfolio to Applied Surety Underwriters.
